Opensense is software platform that unlocks email signatures as a marketing channel and helps businesses manage email signatures & disclaimers for IT, legal, and compliance. 

1. What Information Do We Collect?

We are committed to being transparent with our customers regarding the data we collect from you, protecting your privacy, and disclosing how the data is used and shared. The amount of personal information you are required to supply will normally be limited to that which is necessary to supply the service or carry out the transaction that you have requested. If other information is requested, it will be labelled as optional. We collect information from you when you register on our site, place an order, subscribe to our newsletter, respond to a survey or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address or phone number. You may, however, visit our site anonymously. 

2. Consent

By using the services provided by Opensense (“Service”) you accept and agree to our use of your data under this Privacy Policy and our terms of service. 

3. What Do We Use Your Information For?

Any of the information we collect from you may be used in one of the following ways:

  1. To personalize your experience (your information helps us to better respond to your individual needs)
  2. To improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you)
  3. To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs)
  4. To process transactions
  5. To administer a contest, promotion, survey or other site feature
  6. To send periodic emails

4. How Do We Protect Your Information

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. While the security of your data is extremely important to us, remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. We use strong encryption and SSL-only access as well as password, network, and other security policies & procedures to protect your data. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. We will notify you within 30 days of any serious data or privacy breach. 

5. Payments 

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. Our payment processor is Stripe (https://stripe.com) and it's privacy policy is located at https://stripe.com/us/privacy; the contact, payment, and billing address data may be store more than 60 days in order to provide automatic subscription billing.

6. General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), Opensense legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. Opensense may process your Personal Data because: (1) We need to perform a contract with you; (2) You have given us permission to do so; (3) the processing is in our legitimate interests and it's not overridden by your rights; (4) for payment processing purposes; and (5) to comply with the law.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Opensense aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data. If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us at help@opensense.com. In certain circumstances, you have the following data protection rights: the right to access, update or to delete the information we have on you; the right of rectification (the right to have your information rectified if that information is inaccurate or incomplete); the right to object to our processing of your Personal Data; the right of restriction (to request that we restrict the processing of your personal information); the right to data portability (the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format); and the right to withdraw consent (the right to withdraw your consent at any time where Opensense relied on your consent to process your personal information).

Please note that we may ask you to verify your identity before responding to such requests sent to privacy@opensense.com. You also have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

Subprocessors: Opensense currently uses third party Subprocessors to provide infrastructure services, and to help us provide customer support and email notifications. Prior to engaging any third party Subprocessor, Opensense performs diligence to evaluate their privacy, security and confidentiality practices, and ensures that an appropriate agreement implementing its applicable obligations. Opensense does not save customer emails, but may use the following Subprocessors to host process data or provide other infrastructure that helps with delivery of our Services:

A. Amazon Web Services, Inc, Cloud Service Provider (US)
B. Google Inc., Cloud Services Provider (US)
C. OVH Inc., Cloud Service Provider (Canada)
D. HiVelocity, Dedicated Hardware Provider (US)

Opensense may use the following Subprocessors to perform other functions as part of our Service:

A. HubSpot Inc., Customer Contact, Support and Billing Contacts (US)
B. SaaS Optics, Customer Data related to invoicing (US)
C. Stripe, Customer Payment Profile & Data (US)

7. Do We Use Cookies?

Yes (Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information

We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

8. Log Files

We may collect demographic information, such as your ZIP code, age, gender, preferences, interests and favorites using log files that are not associated with your name or other personal information. There is also information about your computer hardware and software that is automatically collected by us. This information can include: your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used by Opensense to provide general statistics regarding use of the Opensense Website. For these purposes, we do link this automatically-collected data to Personal Information such as name, email address, address, and phone number.

9. Flash Cookies & Analytics

The Adobe Flash Player (and similar applications) use technology to remember settings, preferences and usage similar to browser cookies but these are managed through a different interface than the one provided by your Web browser. This technology creates locally stored objects that are often referred to as "Flash cookies." Opensense does not use Flash cookies.

We may use third-party Service Providers to monitor and analyze the use of our Service. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. 10. Do We Disclose Any Information To Outside Parties?

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information except to trusted third parties who assist us in operating our website, conducting our business, or servicing you; these parties are obligated to keep the information strictly confidential. We may also release your information when we believe release is appropriate to comply with the law, a subpoena, to enforce our site policies, or to protect our's or others' rights, property, or safety. In addition, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. Data subjects will be notified if their personal information is disclosed as a part of a legal request, to the extent legally permitted by law.

11. Data Retention

We retain the personal data you provide while your account is in existence or as needed to provide you Services. We will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Clients. Opensense will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Data can be removed upon request of a customer at the end of a predetermined agreement or upon cancelation by contacting us at help@opensense.com.

Users (and data subjects) have the ability to request an export and/or delete of their Personal Information in the Opensense app as well, in accordance with Article 17 of GDPR by contacting us at help@opensense.com. You can also inquire about Personal Information that Opensense has about you by emailing gdpr@opensense.com. You may be asked additional information to confirm your identity prior to disclosing any PII.

11. Third-Party Links

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

12. Children's Privacy

Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

13. Google User Data

For customers who choose to install our G-Suite Marketplace App integration, we may synchronize your employee directory including user attributes, group attributes and organizational unit attributes for the sole purpose of generating correct email signatures.

15. Changes to Our Privacy Policy

Opensense reserves the right to update this policy at any time without prior notice. Your continued use of our Service after we publish or send a notice about our changes to this Privacy Policy means that you are consenting to the updated Privacy Policy. Any new features or tools which are added to the current Service shall also be subject to the Privacy Policy.
